PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY CREATING AN ACCOUNT OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.

1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and NOR/MAN ("NORMAN," "we," "us," or "our"), governing your access to and use of the NORMAN platform, website, and related services (collectively, the "Services").

By checking the acceptance box, creating an account, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. ELIGIBILITY AND ACCOUNT REQUIREMENTS

2.1 Age Requirement
You must be at least 13 years of age to use our Services. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2.2 Account Creation
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete. You are responsible for maintaining the confidentiality of your account credentials.

2.3 Account Types
NORMAN offers different account types including Athlete Accounts and Coach Accounts. You agree to register for the account type that accurately reflects your status and intended use of the Services.

3. DESCRIPTION OF SERVICES

NORMAN is a track and field recruiting platform that:
- Connects high school track and field athletes with college coaches
- Collects, analyzes, and presents athletic performance data
- Provides AI-powered scoring and assessment tools based on World Athletics standards
- Facilitates communication between athletes and coaches
- Conducts research on athletic performance and recruiting patterns

4. DATA COLLECTION AND USE

4.1 Athlete Data Collection
By using our Services, athletes acknowledge and agree that NORMAN will:
- Collect performance data including race times, meet results, and athletic statistics
- Aggregate data from public sources including athletic.net, results websites, and meet results
- Store and process personal information including name, school, graduation year, and contact information
- Display athlete profiles and performance data to verified college coaches
- Use athlete data for platform improvements, analytics, and research purposes
- Collect training data from connected platforms (Garmin Connect, Strava, Coros) if you choose to integrate them

4.1.1 Training Platform Integrations
If you choose to connect third-party training platforms:
- You authorize NORMAN to access and collect your training data through secure OAuth connections
- Data collected includes workouts, activities, performance metrics, GPS data, and related training information
- You can disconnect any training platform at any time through your account settings
- Disconnecting stops new data collection but historical data may be retained per our retention policy
- Training platform data may be shared with verified coaches as part of your recruiting profile

4.2 Research and Revenue Generation
You acknowledge and expressly agree that:
- NORMAN may use anonymized and aggregated athlete data for research purposes
- Research insights derived from platform data may be used to generate revenue through reports, analytics products, or consulting services
- Individual athlete data will not be sold to third parties, but aggregated insights and trends may be monetized
- Athletes retain ownership of their personal performance achievements but grant NORMAN a license to use, display, and analyze this data as described in these Terms
- Training data from connected platforms (Garmin, Strava, Coros) may be used in anonymized research to study training patterns and performance correlations

4.3 Public Information
Performance data submitted to or collected by NORMAN may be publicly displayed on athlete profiles visible to verified coaches. Athletes understand that profile information is intended to facilitate recruiting opportunities.

5. USER RESPONSIBILITIES AND CONDUCT

5.1 Athletes Agree To:
- Provide accurate and truthful information about athletic performance and achievements
- Not exaggerate, falsify, or misrepresent performance data
- Comply with NCAA eligibility rules and amateur status requirements
- Promptly update profile information to reflect current status
- Not create multiple accounts or impersonate others
- Understand that connecting training platforms (Garmin, Strava, Coros) shares training data with coaches
- Manage training platform connections and privacy settings responsibly

5.2 Coaches Agree To:
- Complete verification process and provide proof of coaching affiliation
- Use athlete data solely for legitimate recruiting purposes
- Comply with NCAA recruiting rules and contact regulations
- Not share login credentials or allow unauthorized access to coach-specific features
- Respect athlete privacy and use contact information appropriately

5.3 Prohibited Conduct
Users shall not:
- Use the Services for any illegal purpose or in violation of any laws
- Attempt to scrape, harvest, or collect data through automated means without permission
- Circumvent security measures or attempt unauthorized access
- Upload malicious code, viruses, or harmful content
- Harass, threaten, or harm other users
- Violate NCAA rules or amateur athletic regulations
- Use the Services to spam or send unsolicited commercial communications

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Platform Ownership
NORMAN owns all rights, title, and interest in the Services, including software, algorithms (including "The Norman Method"), AI models, design, trademarks, and related intellectual property.

6.2 User Content License
By submitting content to the Services, you grant NORMAN a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for purposes of:
- Operating and improving the Services
- Displaying athlete profiles to coaches
- Conducting research and analytics
- Marketing and promoting the Services

This license includes data from connected training platforms (Garmin, Strava, Coros).

6.3 Athlete Performance Data
While athletes retain ownership of their athletic achievements, by using our Services, athletes grant NORMAN the right to collect, store, analyze, and display performance data as necessary to provide recruiting services.

7. AI-POWERED FEATURES

7.1 AI Chat Assistant "Shoey"
Our Services include an AI-powered chat assistant that may provide information about recruiting, athletic performance, and college programs. AI-generated responses are provided for informational purposes only and should not be considered professional advice.

7.2 Scoring Systems
Our proprietary scoring algorithms (including "The Norman Method") are based on World Athletics standards but represent our analytical interpretation. Scores and rankings are tools to facilitate evaluation and should not be considered official athletic ratings.

7.3 No Guarantee of Accuracy
While we strive for accuracy, AI-powered features may contain errors or limitations. Users should independently verify important information.

8. COACH VERIFICATION

8.1 Verification Process
Coaches must complete a verification process before accessing athlete data. NORMAN reserves the right to:
- Request proof of coaching affiliation
- Verify employment with collegiate athletic programs
- Approve or deny coach account applications
- Revoke verification status for policy violations

8.2 Verification Does Not Imply Endorsement
Verification confirms coaching affiliation but does not constitute endorsement by NORMAN or guarantee compliance with recruiting regulations.

9. PRIVACY AND DATA SECURITY

Your privacy is important to us. Our collection, use, and protection of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to our Privacy Policy.

10. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NORMAN DOES NOT WARRANT THAT:
- The Services will be uninterrupted, secure, or error-free
- Data displayed on the platform is accurate or complete
- Use of the Services will result in recruiting opportunities or athletic scholarships
- AI-powered features will provide accurate or reliable information

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NORMAN SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, opportunities, or goodwill
- Damages resulting from recruiting decisions or missed opportunities
- Damages arising from unauthorized access to or use of our servers
- Any damages exceeding $100 or the amount paid by you to NORMAN in the past 12 months, whichever is greater

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless NORMAN, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another party
- Content you submit to the platform
- NCAA violations or eligibility issues related to your use of the Services

13. BETA TESTING ACKNOWLEDGMENT

NORMAN is currently in closed beta testing. By participating, you acknowledge:
- The Services may contain bugs, errors, or incomplete features
- Features and functionality may change without notice
- Data and accounts may be reset or deleted during beta testing
- We may request feedback and suggestions for improvement
- Beta access may be terminated at any time

14. TERM AND TERMINATION

14.1 Term
These Terms remain in effect while you use the Services or maintain an account.

14.2 Termination by User
You may terminate your account at any time by contacting support@normandata.xyzdata.xyz Termination does not affect our right to retain data as described in our Privacy Policy.

14.3 Termination by NORMAN
We may suspend or terminate your account immediately, without notice, for:
- Violation of these Terms
- Fraudulent or illegal activity
- Providing false information
- Harassment or abuse of other users
- NCAA violations or eligibility issues
- Non-payment of fees (if applicable)
- Any reason at our sole discretion during beta testing

14.4 Effect of Termination
Upon termination:
- Your right to access the Services immediately ceases
- We may delete your account and data, subject to our data retention policies
- Provisions of these Terms that by their nature should survive shall survive, including intellectual property rights, disclaimers, and limitations of liability

15. NCAA COMPLIANCE

15.1 Athlete Responsibility
Athletes are solely responsible for:
- Understanding and complying with NCAA eligibility rules
- Determining whether use of recruiting services affects amateur status
- Reporting potential violations to appropriate authorities
- Consulting with compliance officers at their schools

15.2 No NCAA Affiliation
NORMAN is not affiliated with or endorsed by the NCAA. We do not provide advice on NCAA rules or eligibility matters.

16. CHANGES TO TERMS

We may modify these Terms at any time by posting updated Terms on our website. Material changes will require your affirmative acceptance. Continued use after changes constitute acceptance of modified Terms for non-material changes.

17. GOVERNING LAW AND DISPUTE RESOLUTION

17.1 Governing Law
These Terms are governed by the laws of [INSERT STATE], United States, without regard to conflict of law principles.

17.2 Dispute Resolution
Any dispute arising from these Terms shall be resolved through:
1. Good faith negotiation between the parties
2. Binding arbitration under the American Arbitration Association rules if negotiation fails

17.3 Class Action Waiver

You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.

19. ACKNOWLEDGMENT

BY CHECKING THE ACCEPTANCE BOX AND CREATING AN ACCOUNT, YOU ACKNOWLEDGE THAT:
- You have read and understood these Terms in their entirety
- You agree to be bound by these Terms
- You understand that athlete data will be used for recruiting, research, and revenue generation as described
- You are at least 13 years of age (or have parental consent)
- You understand this is a legally binding agreement
- If you connect training platforms (Garmin, Strava, Coros), you authorize collection and sharing of training data
- You can manage or disconnect training platform integrations at any time
